Payment, Refund, and Cancellation Policy

• I understand the exact dollar amount of the service I am purchasing.
• I understand that ALL RECURRING payments must be set up on electronic automatic withdrawal, unless specifically discussed with Evan Claxton Personal Training LLC.
• I understand that paid-in-full or individual purchases can be purchased using any method - card, cash, check.
• I understand that I will be billed monthly on the date I initiate payment.
• I understand that once I initiate a service contract and payment, I cannot cancel payment until the full value of the service has been paid and there is a $0 balance on my account.
• I understand that if I choose to cancel or stop training prior to the full service payment being fulfilled, I am still required to pay the remainder of the service payment until there is a $0 balance on my account.
• I understand that payment of purchased service must be initiated BEFORE service begins.
• I understand that if my payment is not current, I will NOT receive training or service.
• I understand that it is my responsibility to be aware of exactly what services, benefits, perks, etc, I am receiving when purchasing a service, and that I am not to expect more time, services, discounts, etc, than what is outlined in the service I purchased.
• I understand that all sales are final. NO PAYMENTS are refundable or transferable.

For 1 on 1 and Small Group Clients - 12 Week Packages

• I understand that if Evan Claxton Personal Training LLC cancels a session, for any reason, and is not able to reschedule for that same week, the amount of session(s) cancelled will be added onto the end of the 6 weeks.
• I understand that the ONLY time your individual sessions will extend past 6 weeks without initiating new payment is if Evan Claxton Personal Training LLC cancels one or more sessions during your 6 weeks.

For ECPT Mobile Clients

• If purchasing the 3 month options, I understand that I am purchasing a service that runs in 3 month contract increments.
• If purchasing the month to month option, I understand that I am purchasing a contract that runs in 1 month contract increments.
• For the 3 month option, I understand that my service and payment will be automatically renewed after the 3 months, unless otherwise specified.
• For the month to month option, I understand that my service and payment will be automatically renewed each month, unless otherwise specified.
• I understand that ECPT Mobile is a do-it-yourself service that does not come with any additional coaching, communication, sessions, etc.
• I understand that if I want additional coaching, communication, face time, etc, from Evan Claxton Personal Training LLC, I need to purchase individual personal training sessions.
• I understand that once the 3 months (or monthly) has passed and new payment has not been received, my service is officially over and all benefits EXPIRE including, but not limited to: app access, etc.
• I understand that once the 3 month (or monthly) has passed, I must initiate new payment before continuing with any portion of Evan Claxton Personal Training LLC's services.

 
Session Cancellation, Rescheduling, and General Communication Policy

• I understand that if I cannot make the agreed upon session time, I am to text Evan Claxton Personal Training LLC AS SOON AS POSSIBLE.
• I understand that if I am late to my session, whether in person or online, the length of time I am late will be subtracted from the total session time and not be refunded.
• I understand that if I cannot make the agreed upon time, Evan Claxton Personal Training LLC will offer potential rescheduling times for THAT WEEK.
• I understand that if I cannot make the agreed upon session time and want to reschedule, there is no guarantee that Evan Claxton Personal Training LLC will be able to reschedule that session.
• I understand that if I cancel a session with less than 24 hours to the agreed upon session time, the session will expire.
• I understand if I request to reschedule a session and that session cannot be rescheduled that week, the session will expire.
• I understand that Evan Claxton Personal Training LLC will respond to all communication within 24 hours MONDAY - FRIDAY.
• I understand that Evan Claxton Personal Training LLC will be unlikely to respond on weekends and all major holidays.
• I understand that text, email, or ECPT app messaging are the best ways to get a hold of Evan Claxton Personal Training LLC.

 
Miscellaneous Policy

• I understand that it is my responsibility to inform Evan Claxton Personal Training LLC of any changes in my health, now and ongoing, which might affect my ability to exercise safely.
• I understand that I am not obligated to perform nor participate in any activity that I do not wish, and that it is my right to refuse such participation at any time during my training sessions.
• I understand that should I feel lightheaded, faint, dizzy, nauseated, or experience pain or discomfort, I am to stop the activity and inform Evan Claxton Personal Training LLC.
• I understand that the effectiveness of the service and my progress depends on my effort and cooperation in AND outside of the gym.
• I understand that following the plan exactly as prescribed is EXTREMELY important to my success.
• I understand that if I deviate from the prescribed plan in any way, this may have a negative effect on my results and the overall effectiveness of the plan.
• I understand that my app login email and password is for ME ONLY, and if I am caught sharing these details or app access with anyone my service will be CANCELLED IMMEDIATELY and NO REFUNDS will be given.
• I understand that Evan Claxton Personal Training LLC and MUST LLC are two separate entities, and it is my responsibility to communicate with MUST Gym about all things pertaining to MUST gym including, but not limited to: basic membership form/payment, facility questions, etc.
• I understand that if I cease to be involved in a training service, it is my responsibility to inform MUST Gym whether I want to continue as a basic member or cancel.
• I understand that once my Evan Claxton Personal Training LLC package is over, I will still be charged by MUST Gym for my basic gym membership unless I notify them otherwise.

Your personally identifiable information is kept secure. Only authorized employees, agents and contractors (who have agreed to keep information secure and confidential) have access to this information. All emails and newsletters from our sites allow you to opt out of further mailings.

Evan Claxton Personal Training LLC will never sell, trade, rent, exchange or otherwise share your personal information with any other person, company or organization.
